Govt introduces new bill in LS to widen definition of employee

The government has introduced a new bill in Lok Sabha to widen the definition of “employee” and bring in more people under the ambit of the Payment of Gratuity Act.

Minister of State for Labour and Employment Oscar Fernandes on Thursday moved the Lok Sabha to withdraw the Payment of Gratuity (Amendment) Bill, 2007 and introduce the Payment of Gratuity (Amendment) Bill, 2009 in its place.

In both the bills, the definition of “employee” has been widened to include any person who is employed for wages, other than an apprentice. It also clears that the terms of such employment may be express or implied, in any kind of work, manual or otherwise.

In view of a Supreme Court order in a matter pertaining to qualification of teachers for payment of gratuity under the Act, the amendments were first introduced in Lok Sabha on 26 November 2007.

The same was then referred to the Standing Committee on Labour which made certain recommendations.

On the basis of these recommendations it was deemed to give effect to the amendment retrospectively from 3 April 1997, the date on which the provisions of the said Act also became applicable to educational institutions.

Rift between All India Services and Central Services widening

It is always heartening to know that government is functioning smoothly like well-oiled machinery. If not that then at least the parts are working properly even if with less lubrication, but what of when the parts are working against each other?

Imagine a car the front wheels of which spin forward and the rear wheels spin backwards. Something similar is happening in the bureaucracy off late. With the IAS and IPS increasing the distance between themselves and the Central Civil Services Group ‘A’ it is but anyone’s guess how this car is supposed to move at all going forward.

The IPS have got their stomach full with the salary of DGP in states slated to get the pay scale of Secretary to the Central government. If this weren’t enough the ranks have been upgraded so that Inspector General is now equivalent to the Joint Secretary in the Government of India.

The poor Central Services now not only have slower promotions but also have to haggle with extra HAG level posts before they get the pay scale of Secretary, which is going to be quite frankly a pipe dream for all of them.

The IRS have made fresh representations to bring the parity between All India Services and Central Services again at the highest levels recently. However, it seems like a losing battle and eventually the cracks in status conscious bureaucracy are set to turn into chasms.

How this car hopes to run at all is a moot question.

Assam Cabinet accepts Pay Commission report

The Assam government today accepted the recommendations of the Sixth Pay Commission and its employees are scheduled to get enhanced salaries from this month.

The Cabinet at a special meeting here, presided by Chief Minister Tarun Gogoi, accepted the recommendations of the Pay Commission without much changes this evening, state Parliamentary Affairs Minister Bharat Narah told reporters.

The employees would get salaries with retrospective effect from April one and the arrears would be given in instalments, he added.

The Sixth Pay Commission headed by retired bureaucrat Bhaskar Barua had submitted its report in November last and it was placed in the just-concluded session of the state legislative assembly.

The state government will have to bear a burden of more than Rs 3,000 crore in implementing the new pay scales.
